Slip / Trip & Falls

A fall can cause serious and life changing injuries. Most of the time when a person falls they get right back up. When someone asks you if you are all right, no matter how injured they are most people say that they are fine. After the shock and embarrassment the injury becomes more and more evident.  

If you are injured in a slip/trip and fall accident it is important that you get the witnesses to your fall contact information. Normally, the witnesses are gone before the shock and embarrassment. Most people then make a report at the place where they fell.

It is important that after you seek medical attention, you immediately contact an attorney. Fall cases are more difficult to recover damages for your injuries then other types of cases. In order to recover money for your injuries in most cases you have to be able to prove that the person who owned the property had notice of the defect that caused you to fall. Further, you will most likely have to prove that the defect was the cause of your fall and subsequent injuries.

Some insurance policies have what the insurance companies call “med-pay.” This means that if you are injured the insurance company will pay for you to attend the Hospital and Doctors visits with them paying the bill. Unfortunately, not all insurance policies have this provision and even if they do have this provision the amount of money they pay is usually quite low.

The insurance adjusters who handle slip/trip and fall injuries know that they are difficult cases and as such will ask that you provide them a recorded statement, which very well may hurt your chances to recover money for the damages you sustained.

I just recently had a case where a person went into a fast food restaurant. The floor was wet and the person fell injuring her back. The insurance adjuster offered my client $1000 and said if she did not take the money within a week she would not get anything. My client then contacted me and we discussed the case. She relayed to me that the adjuster was “so nice and seemed like she wanted to help.” We just recently settled the case for $38,000. My client said that she now understands why the insurance adjuster was “so nice” and why she was trying to hurry my client into a quick settlement before she retained an attorney.

Once you have injured yourself due to a trip/slip and fall you should not speak to any insurance adjusters. Remember, it is there job to pay you the least of money they can to settle your case.
